Rolla Divorce Attorney

If you are facing a divorce, it is in your best interests to consult with an experienced Rolla divorce attorney early on. I, Scott A. Hamblin, serve couples and families in Missouri as a divorce lawyer. I know the divorce process is complicated, but with my professional legal counsel, you can resolve your divorce effectively and efficiently. I always work to ensure the needs of you and your children remain at the forefront of the case.

Major Factors in a Missouri Divorce

My experience has taught me that every divorce is as unique as the people involved. Nevertheless, there are some basic issues that exist in many divorces, including:

  • Child custody arrangements and child support (for divorces involving children)
  • The division of marital property
  • Spousal maintenance

When couples are able to agree on all of the issues in their divorce, either on their own or with the help of their attorneys, they may be able to file an uncontested divorce. However, when there are disputes about one or more issues, divorcing couples may be required to ask the court to rule on the matter. I encourage couples to seek a reasonable divorce settlement through negotiation or mediation, but I am also prepared to pursue litigation when necessary.

Child Custody Arrangements

When parents separate, decisions must be made about the child’s care and living arrangements. Missouri generally encourages parents to share physical and legal custody unless there is a compelling reason not to, such as a history of domestic violence. As an attorney who handles both family law and criminal matters, I am experienced in addressing all facets of these complex cases.

In many cases, one parent will have what we think of as primary custody, meaning the child spends the majority of their time with one parent, and the other will have a visitation or parenting time schedule. I have seen this arrangement work well for many families. However, I also help couples craft more personalized agreements that suit their family’s unique needs.

The Division of Your Assets and Debts

In a Missouri divorce, your marital property (the assets and debts you acquired as a married couple) will be distributed between the two of you in a way that is fair, but not necessarily equal. If you’re not able to come to an agreement with your divorcing spouse regarding this division, the court will have the authority to divide your property for you while taking several important factors into consideration. These factors include:

  • The contributions each of you has made to your family’s finances
  • Whether either of you attempted to hide, spend down, or otherwise alter the value of your marital assets
  • The length of the marriage
  • Any unique circumstances that apply to your divorce
  • The financial effects of any prior marriages (child support payments, for example)
  • You and your spouse’s individual levels of education, health status, income, and earning potential
  • Any contractual agreements made between the two of you, such as a prenuptial or postnuptial agreement
