How to Appeal a License Suspension and What to Expect

For most people, the stress of a license suspension stems not only from the inconvenience but also from the uncertainty of what comes next. Appealing a license suspension in Missouri means navigating the administrative hearing process. The first step is to act quickly. After being notified of your suspension, you must request a hearing with the Missouri Department of Revenue. Missing any deadlines can result in the suspension becoming permanent, so timing is critical.

To request the hearing, you must send a written appeal to the Department of Revenue. This letter should include your complete name, mailing address and a statement indicating whether you prefer an in-person or telephone hearing. Including your attorney’s details as your legal representative is also advised. Once your hearing request is submitted, the suspension is paused until the hearing process concludes.

Gathering Documentation and Preparing Your Case

A successful appeal requires thorough preparation. Documentation will be your best ally. For instance, you’ll want to review the Notice of Suspension or Revocation you received when the officer confiscated your license. This notice contains vital information about the case against you, including the reported blood alcohol concentration (BAC) or the reason for suspension.

You and your attorney will also assess whether proper procedures were followed during your arrest and testing. Did the officer have probable cause to pull you over? Were the BAC test procedures accurate, and were the instruments properly calibrated? Questions like these are often key in building a strong defense during your hearing.

What to Expect During the Hearing

The administrative hearing is conducted to determine whether the officer had sufficient cause to arrest you and if your BAC was above the legal limit. Both you and the arresting officer may present evidence. The LDP allows you to drive under restricted conditions, such as commuting to work, school or essential appointments. Applying for an LDP typically requires filing Form 4595, obtaining proof of SR-22 insurance and, in some cases, installing an Ignition Interlock Device (IID).

Reinstatement and Moving Ahead

Once your suspension period ends, reinstating your license will involve meeting certain conditions. You’ll need to pay a reinstatement fee, complete any required programs like SATOP (Substance Abuse Traffic Offender Program) and provide proof of insurance. For repeat offenders, additional steps such as retaking the driver’s examination may apply.
